EPA notices: Advance notification of imports; allocations of ozone-depleting substances

Advance Notification Required for Imports of 23 Chemical Substances. The Environmental Protection Agency has issued a direct final rule that promulgates significant new use rules under the Toxic Substances Control Act for 23 chemical substances that were the subject of pre-manufacture notices. This action requires persons who intend to import, manufacture or process any of these 23 substances for an activity designated as a significant new use to notify the EPA at least 90 days before commencing that activity. This notification will provide the EPA with the opportunity to evaluate the intended use and, if necessary, to prohibit or limit that activity before it occurs.
The EPA notes that the effective date of this rule will be Aug. 24, 2009, unless the agency receives adverse or critical comments or notice of intent to submit adverse or critical comments before July 24. If that occurs, the EPA will withdraw the relevant sections of this direct final rule before its effective date. The EPA will then issue a proposed SNUR for the chemical substance(s) on which adverse or critical comments were received and provide a 30-day period for public comment.
