Presidential Proclamation Amends GSP/AGOA Beneficiaries, Modifies HTSUS

President Bush issued April 17 a proclamation making various changes to the Generalized System of Preferences, the African Growth and Opportunity Act and the Harmonized Tariff Schedule of the U.S.

GSP. The Solomon Islands has been designated as a least-developed beneficiary developing country under GSP, effective with respect to articles entered, or withdrawn from warehouse for consumption, on or after the date that is 65 days after April 17 (approximately June 23).

GSP duty-free treatment for certain fruit and vegetable juices (HTSUS 2202.90.37) from Jamaica has been withdrawn.

GSP duty-free treatment for certain cane sugar (HTSUS 1701.11.05) from Colombia, which was withdrawn because import levels in 2000 exceeded the competitive need limitation despite the fact that a CNL waiver had been issued in 1987, has been restored.

AGOA. Togo has been designated as an eligible sub-Saharan African country and a beneficiary sub-Saharan African country under AGOA, effective with respect to articles entered, or withdrawn from warehouse for consumption, on or after May 19. Togo has also been designated as a lesser-developed AGOA beneficiary; as a result, if and when Togo is designated as eligible for the AGOA textile and apparel benefits, textile and apparel articles produced in Togo from third-country fabric or yarn may be entered duty- and quota-free into the U.S.

HTSUS. The HTSUS is being modified to (a) provide the intended tariff treatment for certain apparel articles imported from lesser-developed sub-Saharan African countries under AGOA and (b) conform to the International Convention on the Harmonized Commodity Description and Coding System.
